Terms of Membership Agreement Agreement: this membership agreement is between Oregon Internet Properties, LLC (OIP), dba Realty Referral Network, an Oregon based corporation, and you, a Real Estate agent licensed in the United States and/or Canada. Term: the term of membership shall be for one year, beginning on the day following receipt of application and annually renewable thereafter, or until such time as the agreement is terminated by OIP for cause. Payment: member agrees to pay using a valid credit or debit card (VISA, MASTERCARD, AMERICAN EXPRESS or DISCOVER) via OIP's secure webserver. Free entries do not require payment. Membership Types: - Free: a free entry displays basic contact information, hotlink to existing website, and inclusion in specialty and/or city search (up to six cities)
- Enhanced: an enhanced entry displays complete contact information, hotlink to both existing website and email, and inclusion in specialty and/or city search (up to six cities). Enhanced entries are $25/year
- Additional Cities: either entry type can add additional cities in blocks of SIX for $6.00 US
NOTE: Enhanced entries sort at the top of search results. All entries are sorted First-In First-Out within their category (Enhanced/Free) Member Information: member agrees to notify OIP of any change to contact information or referral fee percentage paid, and agrees to advertise the minimum fee payable. It is the member's responsibility to verify information contained in this directory, and agrees to hold OIP harmless for errors, omissions or misinformation contained herein. Prior to referral, it is every agent's responsibility to verify the accuracy of the information contained in this directory, including but not limited to referral fee percentage, and will hold OIP harmless for errors, omissions or discrepancies contained herein. Termination: membership shall be terminated under the following circumstances: - failure to pay membership dues, if required
- misrepresentation of membership information or referral fees paid
- inability to receive eMail, or failure to maintain valid eMail address in directory.
- loss or suspension of Real Estate license for any reason
- failure to respond to a request for correction or clarification of directory information within ten (10) days of notification by eMail.
Membership may be reinstated within 30 days of termination by rectifying cause of termination; fees paid will not be prorated or refunded in the event of termination. Upon termination, all directory information and any other data stored in OIP controlled server space will be deleted. It is the terminated member's responsibility to keep backups for said data, and in no case will OIP be liable, either directly or indirectly, for data loss due to termination. Upon reinstatement, member shall be responsible for all fees and/or charges necessary to reconstruct, retrieve or recreate lost entries or data. MEMBER agrees to maintain the directory and to effect changes within a reasonable period of time, or as dictated by their respective state laws. If necessary, OIP will effect changes to the directory upon notification, but it is understood by both parties that the Realty Referrals Network directory is "self maintaining", and that OIP will not be held liable for missing or incorrect information, even if notified by by MEMBER. Further, OIP agrees to promote the directory in ways consistent with Internet promotion, including Search Engine placement, ratings, Links, and targeted eMail campaigns as deemed appropriate by OIP staff. OIP will make every effort to verify corrections and to make directory updates that reflect those corrections in a timely manner. This agreement is governed by the laws of Oregon. In the event of a dispute, OIP and member(s) agree to mediate said dispute when ever possible. In the event of litigation, reasonable attorney fees and court costs will be awarded to the prevailing party. This represents the entire agreement between OIP and member agents. Terms may be changed by OIP with 30 day written or eMailed notice to member. |
